Foreign reporting & international tax compliance

Overseas finances.
A coordinated U.S. filing plan.

Living abroad is only one reason to need foreign reporting. Overseas accounts, investments, business interests, gifts, and trusts can also create U.S. filing obligations. We review the full picture, identify the applicable forms, and define the preparation and accounting work for your engagement.

FBAR · FinCEN Form 114

Foreign bank and financial account reporting, including review of account ownership, signature authority, maximum balances, and currency conversions. The FBAR is filed electronically with FinCEN, separately from your income tax return.

FinCEN FBAR guidance

FATCA · Form 8938

Review and reporting of specified foreign financial assets. Form 8938 has its own thresholds and is attached to your federal income tax return when required. Filing an FBAR does not replace Form 8938; some taxpayers need both.

Overseas income & expat returns

U.S. reporting of foreign wages, self-employment income, rental income, and investment income. We review foreign tax credits (Form 1116), the foreign earned income exclusion (Form 2555), and residency and treaty considerations. Nonresident filing needs, including Form 1040-NR, are assessed separately.

IRS guide for taxpayers abroad

Foreign companies & partnerships

Reporting review for interests in foreign corporations (Form 5471), foreign partnerships (Form 8865), and foreign disregarded entities or branches (Form 8858). We help organize ownership details, financial statements, and related transactions to determine the applicable filings.

IRS foreign corporation reporting

Foreign trusts, gifts & inheritances

Review of Form 3520 for reportable foreign gifts, inheritances, and trust transactions, and Form 3520-A for foreign trusts with U.S. owners. Reporting may be required even when a transfer does not create income tax. Trust classification and legal questions can be coordinated with SCL’s attorneys.

IRS foreign trust and gift reporting

Foreign investments & pensions

Review of foreign mutual funds and other investments for passive foreign investment company (PFIC) reporting on Form 8621. Foreign pensions and accounts with tax benefits abroad also require a separate U.S. tax and reporting review; their treatment depends on the arrangement and any applicable treaty.

IRS PFIC reporting guidance

Foreign-owned U.S. businesses

Review of Form 5472 reporting for applicable foreign-owned U.S. corporations and foreign-owned single-member LLCs treated as disregarded entities. We assess reportable related-party transactions and the required accompanying return, including a pro forma Form 1120 where applicable.

Missed foreign filings & catch-up

Reconcile prior returns, account records, and missing international forms before choosing a filing approach. When streamlined procedures or other disclosure options may apply, we coordinate preparation with SCL’s attorneys to assess eligibility, non-willfulness, and penalty issues before submission.

We identify the preparation work for your engagement and coordinate legal issues with SCL’s attorneys.

Are FinCEN Form 114, FBAR, and FATCA Form 8938 the same thing?

FBAR is the Report of Foreign Bank and Financial Accounts, filed as FinCEN Form 114. It generally applies to U.S. persons with a financial interest in or signature authority over foreign financial accounts whose combined value exceeds $10,000 at any time during the calendar year, subject to exceptions. FATCA Form 8938 is a separate IRS filing for specified foreign financial assets, with different thresholds. Some taxpayers must file both.

What should I bring for a foreign compliance review?

Bring prior U.S. and foreign tax returns, foreign account statements and maximum annual balances, records of foreign taxes paid, business ownership details and financial statements, and documents for foreign gifts, trusts, pensions, and investments. Yes. We review the missing years and records, then coordinate with SCL’s attorneys when disclosure options or penalties need legal evaluation. Streamlined procedures require eligibility review and a certification of non-willful conduct; they are not appropriate for every case. The filing approach is assessed before returns or disclosures are submitted.

How much does tax preparation cost?

Start with a free initial consultation. We review the returns, tax years, records, and services involved, then provide a proposal based on your needs. Ask about expedited filing and evening or weekend appointments when you contact the team; availability depends on the work required.
