IRS back taxes don't disappear — they grow. Penalties and interest compound daily, and the IRS has powerful collection tools at its disposal: liens, levies, wage garnishments, and bank seizures. If you owe back taxes to the IRS, the right time to act is before the IRS escalates. At Segal, Cohen & Landis, we handle IRS back tax cases of all sizes — from individual tax debt in the thousands to complex multi-year business tax liabilities in the millions. Our attorneys analyze your full financial picture, identify every legitimate resolution option available, and execute the one that gets you the best outcome.

How We Help

Our Approach to Back Taxes Attorney

1

Full Tax Transcript Analysis

Before advising you on a resolution strategy, we pull all IRS transcripts — account transcripts, wage and income transcripts, and record of account transcripts — to understand exactly what the IRS shows you owe and why. Transcript analysis often reveals erroneous assessments, duplicate penalties, or expired collection periods.

2

Resolution Strategy Selection

Back taxes resolution is not one-size-fits-all. Depending on your income, assets, and debt level, the right strategy may be an installment agreement, Offer in Compromise, Currently Not Collectible status, penalty abatement, or a combination. We analyze all options and recommend the path that minimizes your total payment and timeline.

3

Penalty Abatement

IRS penalties — failure to file, failure to pay, accuracy penalties — can add 25% or more to your underlying tax balance. We aggressively pursue penalty abatement using First Time Abatement, reasonable cause arguments, and other administrative relief provisions.

4

Collection Hold While Resolving

While we work on a resolution, we take steps to suspend IRS collection action — submitting installment agreement requests, OIC applications, or CNC documentation that places a legal hold on levies and garnishments.

How It Works

The Resolution Process

1

Transcript Pull and Analysis

We pull all relevant IRS transcripts and build a complete picture of your liability — what is owed, when it was assessed, what penalties have been applied, and whether the collection statute of limitations is approaching.

2

Resolution Plan

We present you with a clear resolution plan: the available options, the likely outcomes, the cost, and our recommendation. No surprises.

3

Execution

We prepare and file all applications, agreements, and documentation. We handle all IRS communication. You focus on your life.

4

Monitoring and Compliance

Resolution requires ongoing compliance — filing returns on time, making estimated tax payments, staying current. We monitor your status and alert you to anything that could jeopardize your agreement.

Common Questions

Frequently Asked Questions

How long does the IRS have to collect back taxes?+

Generally, 10 years from the date of assessment. This is the Collection Statute Expiration Date (CSED). Certain actions — OIC applications, bankruptcy, CDP hearings — toll the clock. We always analyze the CSED before recommending a resolution strategy.

What if I can't afford to pay my back taxes in full?+

Most clients cannot pay in full — that is why they seek our help. Options include installment agreements (monthly payments), Offer in Compromise (settle for less), Currently Not Collectible status (payments deferred), and penalty abatement (reduce the balance).

What happens if I don't pay my back taxes?+

The IRS will issue increasingly serious notices, file a Notice of Federal Tax Lien, and eventually pursue levies (bank account seizures) and wage garnishments. Ignoring the problem makes it significantly more expensive.

Can I negotiate IRS back taxes on my own?+

Technically yes, but the IRS is a skilled negotiating counterpart. Taxpayers who negotiate alone frequently make statements that expand their liability, accept agreements they cannot sustain, or miss resolution options they didn't know existed. We strongly recommend professional representation for any significant back tax matter.
