Texas has no personal income tax, and its constitution makes enacting one nearly impossible. That removes one layer of enforcement, but it concentrates everything on the federal side, and IRS activity in Texas is among the heaviest in the country. The state's own tax authority, the Texas Comptroller of Public Accounts, administers the franchise (margin) tax on businesses, a 6.25% state sales tax that local jurisdictions push to 8.25%, and a large sales-and-use-tax audit program that operates entirely independently of the IRS. Frequently Asked Questions — Texas IRS Tax Help

Texas has no income tax. Why would I need a tax attorney?

Because federal tax applies in Texas exactly as it does everywhere else. The IRS audits Texas returns, files federal tax liens in Texas counties, levies Texas bank accounts and wages, and assesses payroll-tax penalties against Texas business owners. No state income tax means there is no state-level program to soften a federal problem.

Does the Texas Comptroller work with the IRS?

They are separate agencies with separate taxes. The Comptroller administers the franchise tax and sales-and-use tax and runs its own audits and collections. A federal IRS resolution does not resolve a Comptroller assessment, and a Comptroller audit does not resolve an IRS matter. SCL handles the federal side and coordinates with state counsel when a Comptroller matter is also open.

I moved from California to Texas. Am I done with California taxes?

Not necessarily. The California Franchise Tax Board audits former residents who keep California income, property, or business ties, and it applies its own residency tests. SCL contends with the FTB daily and defends legitimate Texas residency claims before they become six-figure assessments.
